Court Dismisses Lindsay Lohan’s GTA V Lawsuit
A New York state court has today thrown out a lawsuit by Lindsay Lohan and Karen Gravano, who were attempting to sue Take-Two as they believed that their likenesses had been used without their permission in Grand Theft Auto V. According to the five-judge panel who were overseeing the legal action, the case was dismissed because it was a work of fiction and was covered by First Amendment protection in addition to the fact that their actual names and real-life likenesses were never seen in the game. The ruling states, “this video game’s unique story, characters, dialogue, and environment, combined with the player’s ability to choose how to proceed in the game, render it a work of fiction and satire” meaning that is protected from such lawsuits. Lohan originally sued Take-Two claiming that a character, called Lacey Jonas in GTA V, was based on her. She cited the fact that the character was anorexic and needed help to avoid paparazzi photographers as evidence that the game was violating her right
