Zenimax Being Sued Over Music In Fallout 4 Commercial
Dion DiMucci, the singer often known simply as Dion and for hits such as Runaround Sue, is taking legal action against Bethesda’s parent company. The case concerns the use of one of his tracks in a commercial for Fallout 4 that the artist found “repugnant” and claims that Zenimax did not seek permission to use the song The Wanderer.
According to court papers, DiMucci is seeking $1 million in damages as well as legal costs thanks to the fact that videos of the commercial are still available online. His attorneys claim that their “continued presence is an ongoing irreparable injury”.
The issue seems to revolve around the use of violence in the video more than anything else, with the singer finding the footage to include “morally indefensible” images.
While DiMucci did have a general agreement in place with Universal for the song to be used commercially, he states that it included a clause that meant his own personal approval would have to be given before it could be published.
